I got an incredible email today from a Penny Arcade reader. Dave shared with me an email chain between him and Ocean Marketing (the folks behind the Avenger controller) Trust me when I tell you that this is one wild ride. I’m serious, Mr. Toad would look at this ride and just give a slow clap while shaking his head. I have tried to arrange this as best I can in chronological order. I’ve also removed email addresses and other private information. So let’s just jump right in, here is Dave’s first mail to Ocean Marketing:

I’m not really happy about being forced to pay upfront then have the advertised date of “Early December” be completely missed without any sort of update on availability. I noticed the updated info on the webpage, and I don’t understand why there is absolutely no benefit given to those like me who have already ordered, and paid their money. You’ve had my money interest free for nearly two months, yet now ANY new order will get $10 off….meaning I should just cancel my order for 2 controllers, get my money back, then re-order.

 

My other questions is regarding item compatibility. Ocean Marketing seems to be involved with the Xtendplay controller holder, so I was wondering if the Avenger N-Controller can be used in conjunction with the Xtendplay (for both Xbox and PS3)? Thanks

Yes it can be used with xtend play if you remove the stand and no one is allowed to cancel and re order if we catch anyone doing it we will simply just cancel your order all together and you can buy it retail somewhere else.

 

Things happen in manufacturing if your unhappy you have 7 days from the day your item ships for a refund. You placed a pre order just like any software title the gets a date moved due to the tweaks and bugs not being worked out and GameStop or any other place holds your cash and im sure you don’t complain to activision or epic games so put on your big boy hat and wait it out like everyone else. The benefit is a token of our appreaciation for everyone no one is special including you or any first time buyer . Feel free to cancel we need the units were back ordered 11,000 units so your 2 will be gone fast. Maybe I’ll put them on eBay for 150.00 myself. Have a good day Dan.

Then cancel my order if you want to. I’m making a legitimate complaint about your poor communication and you’re the one stooping to childish levels, a patronizing attitude, and threats. Hell you can’t even get the spelling of my name right.

 

And Gamespot pre-orders…wow what a terrible comparison. Retailers take a couple dollars IF THAT for you to guarantee your game availability on the release date, whatever that is. That’s the understanding and that’s what you get. Plus, I don’t have to complain to Activision or Epic games about these issues because they’re usually not missing the street dates for their AAA titles.

 

Now let’s take YOUR situation:

1) You’ve promised a new product based off the design for an existing, working product

2) For the longest time, you’ve stated on your website (your failure to update regularly is another issue) the initial/special/limited batch of your new product by early December, obviously in time for the all-important holiday gift-giving season. I and thousands of other customers GIVE YOU OUR MONEY, INTEREST FREE on the promises you made online.

3) I reach out to you, on Dec 16 (AFTER you have FAILED TO MEET YOUR ADVERTISED DEADLINE AND FAILED TO COMMUNICATE TO ANYONE WHAT THE SITUATION IS) obviously a little frustrated but more curious about when I and other customers can expect the product we paid for.

4) Your reply to me is a cryptic “Dec 17” with absolutely no explanation of what that means. In the mean time you having been using funds from pre-paid customers to complete Research & Development, product redesigns, and manufacturing mis-steps.

5) You force me to follow-up with an email asking for clarification about what “Dec 17” means since the day has passed and I have yet to receive any new information about my order. Now you instead of ANSWERING MY QUESTION OF WHAT THE NEW DELIVERY DATE IS, you tell me the goods have yet to leave China… Why are you telling me this? I’m not your employee I’m your goddamn customer! TELL ME WHAT THAT MEANS IN TERMS OF MY TIME AND WHEN I CAN EXPECT MY PRODUCT I PAID FOR.

6) So great…I have to email you AGAIN trying to get a CLEAR answer from you whether a Dec 24th delivery date is possible and if not, what the new date is. Rinse & repeat: You give me an update of the delivery process (wow, thanks…you haven’t told me anything I don’t know about the order of international shipping procedures) but instead say “...so its wither before or after Christmas.” WHAT THE HELL DOES THAT MEAN? GIVE ME A DATE!? One that you’re actually going to follow, because I already see “late Nov to early Dec”; “Dec 17”; and now “CHRISTMAS” in my rear-view mirror.

7) So I guess what’s left for me to do but just wait? Oh but what’s this, you’ve updated your website…Ok at least you’ve clarified the dates more, I can expect my controller my latest first week of January. But now as a “token of our appreciation” to all your “loyal customers” (you mean like customers who put up cash for you hold an use?) you’re giving a $10 coupon. Let me get this straight…so you held my money interest free for 2 months to help bring this product to market, and now some new customer can place an order and pay $10 less than what I paid? You have financially penalized me in two ways for being a “LOYAL CUSTOMER.”

 

I’m SURE you’re getting tons of other inquiries and I’m sure you’re not enjoying the fact that your product is not out when you wanted it to be. I and everyone else understands that “sh*t happens,” but if you want us to be understanding of that, then you need to keep us in the loop. You’ve already set yourself up for failure by making explicit promises that aren’t even “likely” given that the design and manufacturing are still be refined. Then you make sure you’re going to fail by actually taking all of our money, Not just a little bit….THE WHOLE F*CKIN BEEFALO. Why wouldn’t we trust that you’re going to deliver our merchandise on time? Besides…it’s based off an existing product so how hard can it be? Well as your youtube video shows, making any consumer device is hard and requires many iterations and improvements. But I’m not going to apologize for holding your feet to the fire. You created these expectations by acting like the release was already a done deal and by hiding the fact that it was faaaar from it.

 

I want my two n-controllers. I 1) PAID FOR THEM 2) WAITED 3) DEALT WITH YOUR UNHELPFUL ASS. I also didn’t want to feel like my trust and loyalty as a customer was being abused and then actually punished in comparison to other customers. But I guess we can’t have it all… so right now I’ll settle for getting my merchandise and hopefully never having to deal with you again. I’ve spent enough time writing this email which I hope you gain some insight from. If you actually do want to screw me over by not fulfilling my order, then I assure you be hearing more from me or people representing me.

 

You show a surprising lack of business polish for someone who’s quite established, AND an lack of awareness of your customer base: Hardcore gamers. We’re a demanding, vocal customer but the flip side is we’re loyal and eager to spend. It’s lucky for you that I really want this product because it seems really deliver on making the gaming experience more effective and enjoyable. Hell, I want to combine the aventer-controller with the xtend play to make the ugliest, most comfortable, most awesome controller ever. And I’ll still buy the xtend, so let that be a testament to your products, the rise above your poor representation.

I think of Child’s Play and if anyone’s gonna need greater accessibility when using complicated gamepads…it’s sick kids! "I'm not sure I'd actually do that, since I don't want to get in any fights," he clarified.

So what lessons has Christoforo taken from his brush with Internet infamy? "I'll definitely stay away from customer service emails," he said. "I could have nipped this all in the bud by being a little nicer. You never know who knows who, and lesson learned. We all have bad days and they caught me on one."

Hey Dave,

I just wanted to apologize for the way our emails progressed from beginning to end , You caught me on an extremely bad day and I had been dealing with 100’s and hundreds of emails trying to explain the situation to everyone on where the product was and you just pushed me a little too much and I should have just apologized and tried to explain things better. Also I had a really bad day losing a friend to an overdose and the stress of my newborn baby and the Holiday ,missing my family and just stressing on getting product out to everyone and why it was held up in customs wore me out.

I am deeply sorry for any disrespect , aggravation or lack of information on the delivery date. We knew when product was leaving china and we were trying to adhere to a strict deadline but due to port issues and air freight issues. The units are domestic now and awaiting pick up at customs . So we missed the 17th deadline and I apologize for that but it was out of my control and besides me no one else was helping me handle the situation so imagine the weight on my shoulders.

I’m not asking for any sympathy just for some understanding and forgiveness , I’m human just like everyone else and made a mistake. I underestimated you and its cost me a lot of trouble thousands of spam emails , a lot of personal bashing , and internet spam and trouble and just overall stress with my wife and newborn. I ask that you please accept my apology as a peace offering I will refund your money and give you your 2 units/Avengers free of charge please help me to get some of this negativity removed or at least my personal name although its already all over the internet and the calls and emails will not stop but any help will be appreciated especially with penny arcade as Mike and edit his own website I owe him an apology too which I will write next.

I just wanted to post an update with some of the stuff that has happened over on my end with regards to all this Ocean Marketing stuff.

Around midnight last night Paul sent me a mail saying that I could expect to hear from their attorneys. As of right now that still has not happened and honestly I don’t expect it will. Our attorneys (who are real people with an office and everything) are ready should it get to that point though.

 

At 7:12am this morning I got another mail from Paul. It was one line and simply said:

 

“You have the power Mike Please make it stop”

 

The reality is that once I had posted the emails I didn’t have the power anymore. The Internet had it now and nothing I said or did was going to change that.

An hour later I got a more complete apology:

I just wanted to apologize for the way our emails progressed I didn’t know how big your site was and I really didn’t believe you ran Pax , So for what’s its worth I am very sorry. Your post has obviously made my life very difficult and I have not slept yet dealing with all the spam and personal information intrusion as well as my family being smeared on the internet.

 

If you can please accept my apology and anything you can do to help if not me my son and wife please do. I have apologized to Dave and apologized to you what else can I do please tell me so I can make things good. I obviously care or I would not be emailing you.

 

I think there is a big difference between being sorry and being sorry you got caught. I have a real problem with bullies. I spent my childhood moving from school to school and I got made fun of everyplace I landed. I feel like Paul is a bully and maybe that’s why I have no sympathy here. Someday every bully meets and even bigger bully and maybe that’s me in this case. It’s the same thing that happened with Jack Thompson. It might not always make the most business sense and it is a policy that has caused us some legal problems, but I really don’t give a shit about that. When these assholes threaten me or Penny Arcade I just laugh. I will personally burn everything I’ve made to the fucking ground if I think I can catch them in the flames.

AVENGER CONTROLLER DISMISSES MARKETING CONSULTANT,

 

TAKES BACK MARKETING AND SALES OPERATIONS

 

Miami, FL--- Wednesday, December 28, 2011--- N-Control, makers of the Avenger Controller accessory, have categorically dismissed third party contractor Paul Christoforo and his marketing operation, known alternately as Ocean Distribution or Ocean Marketing. This separation from Mr. Christoforo extends to all business interests of N-Control, its founders, and its officers. Mr. Christoforo does not and never did own, in whole or in part, a stake in N-Control LLC nor its affiliated companies (Kotkin Enterprises, iControl LLC).

 

Following the publication of an email chain between Mr. Christoforo and one of N-Control’s customers, punctuated by Mr. Christoforo’s acknowledgement of his conduct, N-Control immediately proceeded to extricate Mr. Christoforo’s access to their email and social media accounts, a process that is still ongoing. In the interim, a Gmail address and Twitter account (AvengerDefender@gmail.com and @AvengerDefender, respectively) have been set up for press inquiries and customer service needs.

 

David Kotkin, the inventor and founder of the Avenger Controller, created the product to help one of his students who had a physical disability. The student wanted to play games the way that everyone else could. The Avenger evolved from a homemade solution for a deserving child into an even more sophisticated controller accessory, capable of enhancing even the most skilled gamer’s performance.

 

“Everyone deserves the opportunity to be a part of the gaming community in a fun, positive way.” said David Kotkin, Avenger founder. “I created the Avenger to make people happy. I deeply regret that so many people have any negative feelings toward it as a result of what has happened, especially since I’ve seen first-hand what an impact it can have on gameplay.”

 

Kotkin continued, “What I’m most concerned about is doing right by our customers. We have dropped the ball by giving them delivery estimates that did not come through as expected. We didn’t expect that the demand would be so great, and we should have done a better job communicating that. Our new team is taking all necessary action to correct that going forward. I hope that people will give us a chance to earn back the faith they may have lost.”

 

All existing orders will be honored, and PS3 Avenger pre-order customers will all be extended the same $10 discount that some have already received. To clarify, customers who have already received $10 off their pre-order are not eligible for an additional discount. N-Control agrees with “Customer Dave” that all of our PS3 early adopters deserve to be rewarded for their trust in the Avenger.

 

N-Control would like to publicly apologize to existing and potential customers, as well as the gaming community at large, for allowing Mr. Christoforo to abuse his power so unforgivably. The Avenger was invented to provide greater accessibility to disabled gamers, and bullying tactics are the last thing that should be associated with this product.

 

In the effort to dispel various misconceptions that have been forwarded via news reports and social media, N-Control is offering the following clarifications on a variety of subjects:

 

N-Control has hired an independent consultant, Austin, Texas-based Moisés Chiullan (@moiseschiu), to field press inquiries and oversee sales and marketing operations going forward. They ask that customers and the press alike bear with them as they field the tens of thousands of emails and other messages that N-Control has received. It is his intent that N-Control should respond personally to everyone who has emailed theinfo@avengercontroller.com address regarding this situation.

 

“We have to move forward and take care of Avenger’s customers,” Chiullan said. “I can’t worry about the fact that there isn’t a bus big enough for me to throw Paul Christoforo under. The internet did that for me. I think they set him on fire too.” He continued, “I just hope that people will have the common decency to leave his wife and child out of all this. They didn’t send those emails, Paul did.”

 

All PS3 Avenger pre-orders are currently slated to ship by January 15th at the latest. Some orders will ship in advance of January 15th. In consideration of the events of the past two days, N-Control ask their customers to bear with them as they sort out updating individual order estimates. General updates regarding shipping will be regularly delivered to customers starting next week.

 

At no time during his tenure with N-Control did Mr. Christoforo have direct access to customer credit card information. N-Control does not retain any customer credit card data for online orders, which are all processed via Google Checkout or Paypal.

 

Ocean Marketing aka Paul Christoforo owns no stake in the Avenger Controller nor N-Control, and does not stand to profit from further sales of the device either through N-Control or authorized resellers.

 

Contrary to how Mr. Christoforo may have presented events (in public or private), N-Control never directly endorsed nor had knowledge of his communication with customers in the manner found in his correspondence with “Customer Dave”, who still wants his Avengers, despite everything that has transpired.

 

Steps have been taken to ensure that all future customer communication is transparently visible to management at N-Control. N-Control regrets sincerely that the trust they placed in Mr. Christoforo was so abused and betrayed and, as a result, may have tainted their reputation with existing and potential customers and partners.

 

Regarding “Afternoon Artists”, a company registered with the Florida Division of Corporations that lists Paul Christoforo as Treasurer, N-Control has the following statement: “This secondary business has never so much as opened a bank account, much less operated in any form outside of paperwork being filed. It was originally intended that Mr. Christoforo would serve as an investor in this company, which, again, has never operated in any capacity, nor will it in the future.”

 

N-Control employs Eli Schwartz as a part-time Social Media Consultant. He is an enthusiastic high school student who became one of the Avenger’s earliest super fans, meeting the founder at a trade show. Mr. Kotkin is proud to encourage the development of a bright, enthusiastic young person like Eli.

 

Eli Schwartz is not, however, in charge of Marketing or PR for N-Control. Previous news reports have credited him as Marketing Manager, a title Mr. Schwartz gave himself without the consent or advance knowledge or N-Control management. This occurred during the period of greatest upheaval following Mr. Christoforo’s dismissal, and N-Control regrets that this mixed messaging reached the public. All press inquiries and media requests should instead be directed to Moisés Chiullan at the AvengerDefender@gmail.com address.

 

Contrary to rumors and speculation, Eli Schwartz’s Twitter account is his own and not controlled by Paul Christoforo. Mr. Schwartz is a minor, and consequently, N-Control would appreciate the press and the public’s discretion in their dealings with him.

 

For the foreseeable future, N-Control’s official Twitter account will be “@AvengerControl”, as N-Control does not have access to “@NControlAvenger”. N-Control is not responsible for the content of any Twitter feeds associated with Paul Christoforo.

 

For the foreseeable future, N-Control requests that customers discontinue use of the toll-free phone number displayed on the AvengerController.com website, as well as any other means of contact found there. Instead, customers should direct communication to AvengerDefender@gmail.com. They ask for patience due to the events of the last two days. Keep an eye on @AvengerControl on Twitter for updates.

New PR guy.

 

I'm incorporating a lot of what I want to say about the series of phone conversations I've had with him.

 

I should preface by saying that I have the sense to leave things at a factual level as much as possible rather than open myself up to claims of defamation, which Paul has routinely thrown around while at once defaming others.

 

I agree with the notion that one does not negotiate with terrorists, which includes bullies. I say that because I have been strategically pacifying a bully for a couple of days now, and I'm done. Diplomacy has failed.

 

I've spoken to Paul many, many times over the last few days.

 

One of the main things that I've learned about him is that he is most concerned about the well-being of his wife and small child, along with his ability to make a living. I can respect and appreciate those things objectively. What I've also learned is that he is partial to protecting those interests without any consideration given to common courtesy or professional engagement.

 

Every comment regarding N-Control's separation from him was met with complaints to me centered around how N-Control was hurting his family and reputation. He insisted that he did the best thing that ever could have happened to the Avenger and N-Control. It is true that there are some positive vibes coming out of this, but I don't think it's inaccurate to say that the majority of that has all resulted from the damage control I put in place on N-Control's behalf. If you take his actions and delete me or someone doing what I've been doing, there is no turnaround in the first place, much less the huge upswing in sales he is imagining far off into the future. I categorically reject the notion that he can take credit for any of my work, forever and ever amen.

 

I played nicer than necessary over the last two days, and gave him a chance to do the right thing (return control of Avenger's email addresses, website, and other assets). The worst thing to do is make demands of someone issuing ultimatums when you want something out of them that they know they can use against you. At every step, I was told by Paul that "I like you and everything, and you're reasonable and just trying to do your job, but if they don't do what I say, things are gonna get ugly."

 

The first day, I told him that if he chose to speak to the press and speak on behalf of N-Control, that all bets were off. He has done that countless times now, and he's been more than warned, and I honestly believe that he doesn't realize that he's doing it. In that early chat, he told me "don't you fucking threaten me! You don't know who the fuck you're dealing with! I will do things to you that you cannot imagine, they are so fucking bad! YOU DON'T KNOW WHAT I'M CAPABLE OF!"

 

I think I know exactly what he's capable of: yelling and intimidation, with no real intent to follow through, The great thing about bullies is that when you've dealt with enough of them, you realize they're all configured the same way, generally speaking.

 

I was extensively bullied as a kid. Paul's methods and personality are very familiar to me. I think it should be pretty obvious that it indeed "got better" for me.

 

I de-escalated the conversation with techniques that I learned while caring for children. I reassured him that no one was out to get him, and that he just couldn't lash out like that or no one would want to play with him.

 

I should note that I don't care if he considers any of this condescending, especially considering the patronizing tone he's taken with me in every conversation we've had.

 

In our conversations, he has compared himself to no less than Howard Stern and Charlie Sheen. He has proclaimed himself to be the biggest thing on the internet, and has repeatedly touted how much power he thinks he now has with the press. He told me tonight "if they fuck with me, I got all these websites all over me. Whatever I tell them to write, they write." He says that he has a TV interview with SPIKE TV next week. I look forward to him telling them what to do and what to edit into their coverage.

 

Tonight, he reiterated that in unmistakable, forceful terms. His abrupt swings in tone and mood were astoundingly rapid. He told me he would burn the company to the ground and destroy everyone associated with it, including me, he regretted to inform me. "I know you're just a guy doing a job and you don't know any better. I'm gonna ruin your life if I have to."

 

Most people would have the urge to destroy him after being told that. Of course, that would only need to be said if he hadn't already done such a capable job of that himself. That's the part of the press release I wrote that I think he really didn't get: he needs to stop hurting himself, and consequently his family. He's making everything worse every time he opens his mouth, and for his family's sake, I wish he would stop. I'd be amazed if he can make himself look any worse, but I don't put that past him.

 

I hope that people stop giving him attention, because they're just feeding the beast. As for me, I'm done speaking with him on the phone.

 

I've been trying to get him to give up the access to these things he's been holding hostage (email accounts, Twitter, etc) by asking nicely for a couple of days. The gloves are off now.

 

Paul told me on the phone two hours ago that "Eight months ago, I locked down all this stuff so they wouldn't be able to fuck with me. If they don't give me what I want, it's war." His demands include a contract written on his terms and substantial compensation, both immediate and for as long as the company continues to exist. He flaunted the PR debacle he created as proof that he "made the company a success", citing all the media and public attention as the "best thing that ever happened to Avenger".

 

He didn't count on the fact that I anticipated all of this and have been a computer hardware and web tech since I was 14.

 

The thing we did have is control over the AvengerController.com domain. It was transferred away from its original account, which Paul has complete control of. Because of how GoDaddy works, that old account retained all of the email addresses and their master control settings (forwarding and so on). He has continued to respond to customer emails from his personal GMail account and lied to me repeatedly about doing so.

 

I tried to play nice, and Paul played stupid, acting like he didn't have access to this master account, blaming his "Indian outsourced tech team" being on vacation. I gave him two days to give over N-Control's digital property.

 

He finally leveled with me tonight that he knew I wasn't that stupid and that he was lying about his access to all these accounts. That's when he issued the above-mentioned threat. He reiterated that he had the hosting, email, and everything on lockdown.

 

Unfortunately, since he doesn't control the domain, he couldn't be more wrong. "James", a GoDaddy support rep and avid redditor, who knew exactly who I was, confirmed that I could do exactly what I wanted to...

 

Around a hour ago, I parked the domain and killed all the CNAME settings. All that email and the website may be sitting on servers he has access to, but he can't log in to any of the mail or do anything to the website.

 

I'm getting on the phone with the hosting company to try to get help from them, now that we're past the point of diplomacy.

This guy real needs to stop talking.

 

A couple more developments:

 

- About a day after the new N-Control PR guy did a very informative Reddit AMA, Paul started his own. He gave generally douchey and idiotic responses to questions and then deleted his Reddit account.

 

- Paul lists his former employer prior to Ocean Marketing as Premier Healthcare Online. It has now been confirmed that this is a fake company Paul used to pad his resume.

your interviews came out "wrong"? Are you claiming that the journalists are lying about what you said? You are aware they document everything you actually say and that it can be easily checked? Are you saying they doctored what you said and they changed it? Those are very serious allegations and I am sure that Forbes at the least would love to hear that. They also have excellent lawyers.

oh so it's the public that is making everyones think you held website hostage, lied to your boss about previous interactions and this one, lied about having personal and business relationship with everyone from the mayor of Boston to the editors of most major tech blogs. nope it wasn't Paul's fault, it's everyone else. first it was dave, then mike, then the blogs, then the journalist, now it's the public. Is there anyone else who you'd like to say is MORE responsible for the situation you are in other than yourself?
